W Squared Engineering CC – Terms and Conditions
Introduction
These Terms and Conditions (“Terms and Conditions”) govern the provision of engineering services, the supply of vehicle components and parts, and the use of the website operated by W Squared Engineering CC, registration number 1993/011372/23 (“W Squared Engineering CC”, “we”, “us” or “our”). These Terms and Conditions are binding and enforceable against every person who engages our services, purchases goods from us, or uses our website (“you”, “your” or “customer”). By engaging our services, purchasing goods, or using our website, you acknowledge that you have read and agree to be bound by these Terms and Conditions.
These Terms and Conditions are divided into two distinct sections to reflect the dual nature of our business operations:
- Section A: Workshop Services Policy – applicable to all engineering, machining, and repair services.
- Section B: Parts Supply Policy – applicable to the supply of vehicle components and parts, whether purchased in person or online.
Section A: Workshop Services Policy
Scope of Services
The term “job(s)” shall mean all vehicle components brought in for repairs or service, which shall include engineering work for the development of a reasonable solution to a technical problem by means of reconditioning, machining, or related processes.
Quotations and Authorisation
All jobs will be assessed and quoted prior to commencement of work. No work shall proceed without the customer’s approval of the quotation, which may be provided in writing or verbally. Where stripping is required to prepare a quotation, the Company shall not be obliged to rebuild the unit if the quotation is declined, unless this was expressly agreed in advance.
Payment Terms
Payment of completed jobs shall be due prior to or on the day of collecting the job, unless otherwise agreed in writing under a trade account facility. The Company reserves the right to require deposits of up to fifty percent (50%) of the quoted amount prior to commencement of work, which will be communicated to the customer in advance.
Risk and Liability
Goods are left in the possession of the Company at the customer’s own risk. The Company shall not be liable for any loss or damage to goods due to theft, fire, or other causes beyond its reasonable control. The customer acknowledges that engineering repairs carry inherent risks, particularly where heat treatment or welding is required, and accepts that failed repairs due to metal fatigue shall be deemed to have been in a scrapped condition prior to the attempted repair.
Warranty – Workshop Services
W Squared Engineering CC provides a warranty on its workmanship for a period of three (3) months from the date of completion of the job. This warranty applies only to reconditioned or repaired components and excludes ordinary wear and tear, misuse, abuse, tampering, or incorrect fitment. The warranty shall be valid only where components and parts are fitted by qualified persons, and in particular by an accredited member of the Retail Motor Industry Organisation (RMI). Where goods are not fitted by such qualified or accredited persons, the warranty shall be deemed void and the Company shall be exonerated from any further liability.
All new parts supplied in the course of a repair shall carry the manufacturer’s warranty only.
Dispute Resolution
Any complaint or dispute must be communicated to the Company in writing within seven (7) days of collection. The customer agrees to give the Company the first opportunity to resolve any dispute. If unresolved, disputes may be referred to the Retail Motor Industry Organisation (RMI) or the Motor Industry Ombudsman of South Africa (MIOSA).
Storage
Storage fees shall apply from seven (7) days after notification of completion of a job. Goods uncollected after three (3) months may be sold to defray costs.
Section B: Parts Supply Policy
Ordering of Goods
Orders may be placed online, telephonically, or in person. Placing goods in a shopping basket or wish list without completing the purchase cycle does not constitute an order. Orders are confirmed only upon issue of an invoice by the Company.
Payment
Payment may be made via Ozow secure payment link, electronic funds transfer (EFT), debit or credit card, or cash on delivery where applicable. Unless a trade account has been established, payment must be made within five (5) days of placing an order. Orders not paid within this period may be cancelled. Payments must reflect in our bank account prior to the goods being despatched.
Delivery of Goods
Goods may be delivered via local delivery, courier, or collected in person. Risk passes to the customer upon delivery to the physical address nominated by the customer. The Company shall not be liable for any loss or unauthorised use of goods after delivery. The customer shall be liable for all courier delivery fees, which will be communicated on order or quotation. The customer may arrange their own courier, but must communicate this with the Company.
Returns and Refunds
Customers may return goods within seven (7) days of receipt, subject to the following conditions:
- Goods must be accompanied by the original invoice and a written explanation of the reason for return.
- Goods must be received by the Company for inspection prior to a refund being made. Goods that have been altered, damaged during installation, or misused cannot be refunded.
- Defective goods will be refunded or replaced after evaluation.
- A handling fee of up to ten percent (10%) may be levied for non-defective returns.
- The customer shall be liable for delivery fees associated with the return of non-defective goods or incorrect orders placed.
- Refunds shall be processed at the original purchase price, less any discounts.
Warranty – Parts Supply
In accordance with Section 56 of the Consumer Protection Act, all goods supplied by W Squared Engineering CC carry an implied warranty of quality for a period of six (6) months from the date of purchase, unless otherwise excluded by law. During this period, the consumer may return goods that fail to comply with the requirements of the Act without incurring any penalty. At the sole discretion of the consumer, the Company shall repair, replace, or refund the goods, provided that the failure is not attributable to misuse, abuse, or negligence on the part of the consumer.
This warranty shall apply only where goods are fitted by qualified persons, and in particular by accredited members of the Retail Motor Industry Organisation (RMI). Where goods are not fitted by such qualified or accredited persons, the warranty shall be deemed void and the Company shall be exonerated from any further liability.

The use of the W Squared Engineering CC website is subject to the following conditions:
- The website is provided for information purposes only. Customers must contact the Company directly to discuss orders and obtain quotations.
- You may not use the website in any manner that is unlawful, defamatory, abusive, or intended to disrupt its operation. Automated tools, including artificial intelligence systems, are expressly prohibited from extracting, scraping, or reproducing content from the website without prior written consent.
- By using the website or providing your contact details, you consent to receiving communications from us electronically, including service updates, quotations, invoices, and notices. You may opt out of promotional communications at any time by notifying us in writing.
Notices
For purposes of formal notices and legal processes, W Squared Engineering CC hereby selects its registered office at 25 Hart Street, Sidwell, Gqeberha, 6001 as its domicilium citandi et executandi (“domicilium address”). Customers shall select the delivery address provided with their order as their domicilium address, unless otherwise notified in writing. Notices sent by prepaid registered post shall be deemed received within ten (10) days of posting, and notices sent by email shall be deemed received on the date indicated in the read-receipt notification.

Governing Law
These Terms and Conditions, Privacy Policy, and Shipping & Returns Policy shall be governed by the laws of the Republic of South Africa. Disputes shall fall under the jurisdiction of the South African courts.
Ownership and Copyright
All content contained on the website of W Squared Engineering CC, including but not limited to text, graphics, logos, trade names, trademarks, designs, images, audio clips, video clips, data compilations, and software (“Website Content”), is the property of W Squared Engineering CC or is lawfully licensed to W Squared Engineering CC. The Website Content is protected by applicable copyright, trademark, and other intellectual property laws of the Republic of South Africa and international conventions.
You shall not acquire any right, title, or interest in or to the Website Content.
